About ShawGames & Game Licensing
We take copyright infringement seriously and comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on ShawGames infringes your copyright, please follow the process below.
Designated DMCA Agent
All DMCA notices and counter-notices must be sent to our designated copyright agent:
Use the subject line: "DMCA Takedown Notice" for infringement claims, or "DMCA Counter-Notice" for counter-notifications.
We aim to acknowledge valid notices within 2 business days and act on valid claims within 10 business days.
How to File a Takedown Notice
To file a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your written notification must include all of the following:
- Your signature — a physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work — describe the work you claim has been infringed (e.g., game title, artwork, code), or if multiple works are covered, a representative list
- Identification of the infringing material — the URL or specific location on ShawGames where the allegedly infringing material is located, with enough detail for us to find it
- Your contact information — your name, mailing address, telephone number, and email address
- Good faith statement — a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- Accuracy statement — a statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
Counter-Notice Procedure
If you believe content on ShawGames was removed or disabled as a result of a mistake or misidentification of the material, you may submit a counter-notice under 17 U.S.C. § 512(g)(3).
A valid counter-notice must include:
- Your signature — physical or electronic
- Identification of the removed content — description of the material and its former location on our site before it was removed
- Good faith statement — a statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification
- Your contact information — name, address, and telephone number
- Consent to jurisdiction — a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original DMCA notice
Upon receiving a valid counter-notice, we will forward it to the original complainant and restore the content within 10–14 business days unless the complainant files a court action to prevent the restoration.
Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), ShawGames maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat copyright infringers.
We track infringement claims associated with user accounts and will permanently ban accounts found to repeatedly violate copyright law.
Abuse of the DMCA Process
If you are unsure whether material infringes your copyright, we recommend consulting with a qualified attorney before submitting a notice.
